Agreement to Terms

These Terms of Service ("Terms") govern your use of the HeatherAI application at ai.heatherbauer.com and the marketing website at getheatherai.com (together, the "Service"), operated by Many Brains, Inc. ("we," "us," or "our"), located in Westport, CT.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Description of Service

HeatherAI is an AI-powered nutrition coaching platform built on the coaching methodology of Heather Bauer, RD. The Service provides:

• AI-generated nutrition coaching and meal planning
• Photo-based meal logging and nutritional analysis
• Health and wellness data tracking
• Personalized coaching insights and recommendations
• Weekly coaching video summaries
• Access to registered dietitian sessions (AI + Human Coach plan)

Medical Disclaimer

HeatherAI is not a medical device, healthcare provider, or substitute for professional medical advice, diagnosis, or treatment.

HeatherAI is not currently FDA-registered or approved as a medical device. The coaching, meal plans, and recommendations provided are for informational and educational purposes only. They are based on general nutrition principles and Heather Bauer's coaching methodology, adapted by artificial intelligence to your stated preferences and goals.

You should:

• Always consult with a qualified healthcare professional before making changes to your diet, especially if you have medical conditions, take medications, or are pregnant or nursing
• Not rely on HeatherAI for medical diagnosis or treatment of any condition
• Seek immediate medical attention for any health emergencies
• Inform your healthcare provider about any dietary changes you make based on HeatherAI's guidance

If you are using GLP-1 medications (such as Ozempic, Wegovy, Mounjaro, or Zepbound), HeatherAI can provide nutritional coaching support, but medication management should always be directed by your prescribing physician.

Accounts & Registration

To use HeatherAI's coaching features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your login credentials
• Notify us immediately of any unauthorized access to your account
• Be at least 18 years of age

You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

Subscription Plans & Payments

Available Plans

• Meal Logging (Free): AI meal logging, macro estimates, weight/water/caffeine tracking, and meal history at no cost
• AI Coaching ($29/month): Full HeatherAI coaching, personalized meal plans, restaurant guidance, health trends, proactive check-ins, and personalized video coaching
• AI + Human Coach ($299/month): Everything in AI Coaching plus 2 private Zoom sessions per month with a registered dietitian, personalized plan reviews, and priority support

Billing

Paid subscriptions are billed monthly on the anniversary of your signup date. All fees are in U.S. dollars. You authorize us to charge your selected payment method for recurring subscription fees until you cancel.

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the end of the period you have already paid for. No refunds are provided for partial billing periods.

Price Changes

We reserve the right to change subscription prices. We will provide at least 30 days' notice of price changes. Continued use of the Service after a price change constitutes acceptance of the new pricing.

User Content

You retain ownership of all content you submit to HeatherAI, including chat messages, photos, meal logs, and health data ("User Content"). By submitting User Content, you grant us a limited, non-exclusive license to use, process, and store that content solely for the purpose of providing and improving the Service.

You agree not to submit content that:

• Is unlawful, harmful, threatening, or harassing
• Infringes on the intellectual property rights of others
• Contains malware, viruses, or harmful code
• Attempts to manipulate or abuse the AI coaching system

AI-Generated Content

HeatherAI's coaching responses, meal plans, nutritional estimates, and video summaries are generated by artificial intelligence. While the AI is trained on Heather Bauer's coaching methodology and a proprietary knowledge base, AI-generated content may occasionally be inaccurate, incomplete, or inappropriate.

We do not guarantee the accuracy of any AI-generated content, including but not limited to:

• Calorie and macronutrient estimates from food photos
• Meal plan recommendations
• Nutritional guidance and coaching responses
• Health data trend analysis

You should use your own judgment and consult qualified professionals when making dietary decisions based on AI-generated content.

HeatherAI Identity

HeatherAI is an artificial intelligence coaching system trained on the methodology of Heather Bauer, RD. HeatherAI is not Heather Bauer. Coaching responses are AI-generated based on her methodology, knowledge base, and coaching patterns — they are not direct communications from Heather Bauer personally, except where explicitly indicated (such as in the AI + Human Coach plan sessions).

Intellectual Property

The Service, including its design, code, coaching methodology, knowledge base, coaching frameworks (including but not limited to the "10 Diet Devils," "Six Catalysts to Overeating," "Scaffold, Then Release," and related proprietary systems), and all associated trademarks, are the property of Many Brains, Inc. and are protected by intellectual property laws.

You may not copy, modify, distribute, reverse engineer, or create derivative works based on the Service or its coaching methodology without our written permission.

Limitation of Liability

To the maximum extent permitted by law, HeatherAI and Many Brains, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

• Health outcomes resulting from following AI-generated coaching or meal plans
• Inaccurate nutritional estimates or recommendations
• Data loss or service interruptions
• Unauthorized access to your account

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Many Brains, Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that any content will be accurate or reliable.

Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately, and we may delete your data in accordance with our Privacy Policy.

Governing Law

These Terms are governed by the laws of the State of Connecticut, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of Fairfield County, Connecticut.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
